India Spectrum Auction Nets about 11% of Government-Forecast Revenue

India’s big spectrum auction of 2,300 MHz worth of spectrum has ended, with spectrum sold at about 11 percent of what the government projected would be the case, or roughly US$9.8 billion (if I have converted the crore properly). The government had projected sales in the $83 billion range.

As mobile executives had warned, prices for 700 MHz spectrum were simply wildly overpriced. They behaved as they spoke: nobody made a bid for any of the 700-MHz assets. Mobile executives had suggested the government lower the prices and wait before auctioning the 700-MHz assets.

Of the total of 2,300 MHz of assets, the government sold 964.8 MHz of spectrum. Mobile operators purchased about 34 percent of spectrum in the 800-MHz band, about 75 percent in the 1800-MHz band, all of the spectrum available in the 2300 MHz band and about 60 percent of spectrum in the 2500 MHz band. About 20 percent of spectrum in the 2100 MHz band was bought.

Vodafone USA and Bharti Airtel were the biggest buyers of 4G spectrum, followed by newcomer Reliance Jio Infocomm and Idea Cellular.

Vodafone spent over Rs 20,000 crore, Airtel Rs 14,244 crore, Jio Rs 13,672 crore and Idea Rs 12,798 crore.

The auction results, and the squabbling leading up the auction, illustrate several important facts about the Internet ecosystem. From a mobile operator’s perspective, though spectrum access is a necessary precondition for being in business, operators cannot pay “any amount” for that access.

And mobile operators demonstrated with their wallets that spectrum prices set by the government were too high. There is experience behind that thinking. In the past, mobile operators have overpaid for 3G spectrum, for example, in USA and elsewhere.

Operators have learned, from experience, that the cost of spectrum has to be weighed in view of expected revenues that can be generated by those assets.

There also are a few larger points.

Since, in the end, consumers or advertisers are the ultimate sources of all ecosystem revenue, all costs--anywhere in the ecosystem--must be matched by revenues from those sources.

The USAn auction shows that government officials and mobile operators have vastly-different expectations about the revenues that can be generated by using mobile spectrum.

There are reasons mobile operators and others might rationally expect spectrum to prices to begin dropping. For starters, much more spectrum will be made available as 5G standards are set and regulators start to release brand new spectrum in the millimeter regions.

The role of unlicensed spectrum also is growing, reducing, to a real extent, the need to buy licensed spectrum.

In some markets, spectrum sharing also will add even more resources. Finally, small cell architectures are allowing service providers to make better use of any amount of finite spectrum.

Unlike Blackberry, Microsoft on the other hand is yet to come out plainly to let us know whether they are also planning shifting their line of phone manufacturing business into other venture, but all indications are pointing out that they are quickly losing steam in the phone production arena.

If Microsoft is having underground plans of coming out with something bigger in the phone industry, we believe that leaks and rumours might have surfaced in one way or the other; rather, they more we wait to see if Microsoft will surprise with something great, the more Window phones are appearing less significant by the day.

Generic marks as valuable commercial information

For trademark practitioners, genericness usually has a bad name. If a mark is generic, you can’t register it, no matter how much you use it. If

your mark was once distinctive, but if it is now found to be generic, you may lose your exclusive rights. Indeed, calling it a “trademark” may not even be appropriate, because a generic mark is inconsistent with the principle that a mark is a badge of origin. But there are times when a generic mark makes good business sense, even if it is disfavored by the trademark world.

Case in possible point is the men’s clothing store than opened up a few hundred yards from this Kat’s apartment. The name of the clothing outlet is simply— “Men’s Store”; the store not surprisingly sells a variety of men’s clothing products. This Kat suspects that if the proprietor of “Men’s Store” had come to him (or any other trademark practitioner) for legal advice, counsel would have explained how difficult it will be to protect the mark as a legal matter. “Go back to the drawing board”, is the likely suggested course of action. And yet. The more this Kat thought about the “Men’s Store”, the more it began to occur to him that the mark chosen may in fact be a savvy bit of commercial nomenclature.

The starting point is geography and proximity. When this Kat teaches about trademark law, he likes to begin with the depiction of (an imaginary) village in the middle of 18th century England, where most products, such as they were, were obtained directly and personally from their source. Here and there, a craftsman or guild mark might appear, but for the most part, a purchaser knew from whom he or she was purchasing the goods. In such a case, where there was no need for intermediation via a mark as to source, genericness would have a positive role, because it would provide information about what type of product was being offered.

Something similar is going on with the “Men’s Store”. The name of the store informs passers-by about the type of goods being sold and the store window displays items of men’s clothing. The combination of the name and the clothing items displayed transmit a clear commercial message about what is being offered by the store. Since the store has a single location, located on a commercial suburban street, all the purveyor of the store needs to add, if anything, is perhaps the address. Under these circumstances, joining a so-called distinctive element to the store name would not likely provide further information that will yield commercial value for the store. Genericness is good.

“Wait a minute, Kat”, I can hear readers say. “Your analogy is off the mark. Surely the clothing items sold at “Men’s Shop” are themselves branded. So all we are talking about is a service mark for retail services.” Well, yes, in fact, each of the types of clothing is marked by a single brand—one for shirts, one for suits, and so on. This Kat did not recognize any of them. More to the point, the product brands are largely irrelevant. They are primarily used to give the purchaser some comfort (who ever heard of an unbranded suit?). They don’t drive customer traffic to the store. That is accomplished by the generic name of the store plus its single, fixed location.

“One more thing, Kat, maybe the name isn’t generic but merely highly descriptive?” That is no problem. If it is merely highly descriptive, and a competitor seeks to open another store close-by, the fact that the “Men’s Store” is associated with a given physical location and has enjoyed substantial custom should ensure that custom is not diverted. Moreover, should the proprietor of “Men’s Store” seek to change the business model and to expand to additional locations (though most commercial entities don’t go beyond a single location), if the name is ab initio descriptive and not generic, that will mean it may well be registrable upon a showing of secondary meaning.

Since the 1980’s, many academics have talked about trademarks in terms of providing information with respect to the source of the goods. But genericness is also about information. When this is tied to a single store location, this information has commercial value, even as against potential competitors, and even when no issue of source confusion arises.

Can Internet Access be "Future-Proof?"

Remember when fiber-to-home was touted as “future-proof?” That statement is only partially true, as it was even when originally argued. The “future-proofing” is correct to the extent that physical media does not have to be replaced when a bandwidth upgrade happens (at least for perhaps 15 to 20 year lifetime of the cables).

But continual speed upgrades are part of the market dynamic. Yesterday's ceilings become today's floors. In that sense, no network is fully future proof.

To a large extent, the United Kingdom has succeeded in upgrading most locations to superfast speeds of 24 Mbps. In fact, by some estimates, about 91 percent of U.K. locations can buy Internet access at 30 Mbps. The extent of superfast coverage was about 83 percent in 2015.

Now the near-term goal is to connect 97 percent of U.K. locations at at least 24 Mbps by 2019. Back in 2009, when the idea of upgrades to “superfast” speeds became part of the national agenda, the typical U.K. consumer got speeds of perhaps 4 Mbps.

So a boost of about an order of magnitude in less than a decade is significant, if not unusual. An increase of another order of magnitude is coming, at least in part because other suppliers, using their own facilities, have leapt ahead.

How To Flash or Install ROM:

- Unpack FlashTools, and Click on Flash_tool.exe

- Select "scatter-Loading" and search MT6572_Android_scatter.txt in ROM

- Wait file to be added into Flash Tool

- Select "Download Only" or if upgrade "Firmware upgrade"

- Turn off your phone, remove the battery (if the battery is removable) and replace it after some seconds (and don't turn on the phone).

- Press “Download” button to start

- and connect your phone into the computer via USB data cable.

- The process will start and a red progress bar will appear after color purple, yellow.

- And green circles display

- Finish !

- You can now safely disconnect your phone and turn it on.

Important Notes:[*]Take a Backup of your personal data before flashing or installing the firmware on your smartphone. As this helps you to recover the personal data whenever any thing wrong happens.
